Recent cases where we have assisted families and people who have been affected by brain injuries
Case 1
Our client, a young boy age 7 years old was involved in a major road traffic collision whilst on an open-topped sightseeing tour bus on holiday in Malta. The incident left the boy with massive head injuries causing significant long-term disability. The child was rapidly airlifted to specialists at Royal Manchester Children’s Hospital. Following a detailed assessment of his condition – it was established that he had sustained life-changing injuries and intense ongoing care was required.
Our role in this matter was to secure the young boy and his family the rehabilitation, extensive support and therapy package required. The case was more complex than usual – involving foreign jurisdictions and insurance companies as well as a wide range of ongoing support and therapy valued in the region of £10m. In November 2020, we issued proceedings against the transport authority in Malta as well as the sightseeing company as the Maltese Government continues its Magisterial Inquiry into the matter.
The case settled at mediation prior to preliminary issue trial. Issue was the maximum order under a foreign insurance policy. We secured an offer of £2.4 million which is held on Trust.
Case 2
This case involveds siblings, including a child who was about 18 months old when she suffered a traumatic brain injury and a spinal cord injury, and her six year old brother who suffered a significant traumatic brain injury, following an RTC in which their other siblings were also badly injured. We are engaged in supporting all of the children.
We took over the case from other solicitors who had been engaged for the first two or so years, but disappointingly very little had been achieved during their time in representing the family.
Our immediate focus was to meet the family in their home setting to understand their set up and the many issues they were faced with. And then to focus our attention of engaging with the relevant parties to ensure that appropriate support was implemented as a matter of urgency.
We were quick to establish a positive working relationship with the relevant insurer and their legal team. This resulted in the almost immediate appointment of a case manager who was very experienced in assisting clients with our clients’ level of needs and she has been an ever present advocate and contact for the family overall. We have continued to have regular meetings at our clients’ home, as has the case manager. And through positive dialogue with the insurer and their representatives, we have secured substantial support in terms of extensive rehabilitation support and financial assistance to alleviate as much pressure from this poor family that is possible in all the circumstances.
Case 4
Our client, a 15-year-old boy, was involved in a serious road traffic collision and sustained a traumatic brain injury. Although he was wearing his seatbelt as a passenger in the car he was travelling in, the vehicle rolled and collided with another vehicle on the opposite side of the carriageway.
Initially in this case, primary liability was admitted only. Causation and Quantum remained in dispute particularly over a dispute whether our client was wearing a seatbelt. After securing vital expert evidence we were able to successfully argue our case and the case was settled on a 100% liability basis,
Confusion, forgetfulness, physical and emotional symptoms had a major impact on his home life. He was at serious risk of mismanaging medication. He also suffered from headaches, migraines and experienced dizziness and disturbance to his balance. As well as brain injury, major head injuries, spinal injuries, broken bones and soft tissue scarring triggered a major change in his circumstances and that of his supportive family.
Our team ensured we secured rapid extensive rehabilitation, appointed a first-class case manager and secured the funding by the insurer quickly. Following an extensive Multidisciplinary rehabilitation programme our client progressed in all areas of his life and nis now the father of two children. More recently, our client is going from strength to strength including passing his driving test (we ensured measures were put in place to assist him passing his theory test). He is now able to care for his own family and has the independence that we always aimed to secure for him right from the beginning.
We were able to secure a settlement of £2m for our client and his family.
